Terms of Use
These Terms of Use govern access to and use of gemba.org.in (the "website"), operated by GEMBA Access and Impact Foundation ("GEMBA", "we", "us" or "our"). By using the website, you agree to these Terms. If you do not agree, please do not use the website.
GEMBA Access and Impact Foundation is a Section 8 not-for-profit company incorporated in India with CIN U88900BR2024NPL071111 and registered office in Patna, Bihar, India.
Purpose of the website
The website provides general information about GEMBA, its capabilities, leadership, governance and ways to begin an institutional conversation. It may also provide evidence-informed articles or resources when those are approved for publication.
Website content is general information. It is not medical or clinical advice, diagnosis or treatment; legal, financial or tax advice; an emergency or beneficiary-support service; a procurement decision; or a substitute for qualified professional advice tailored to a specific situation.
GEMBA is not a government authority, emergency service or healthcare provider through this website. Do not delay seeking appropriate professional or emergency assistance because of information displayed here.
A website interaction is not a formal engagement.
Accessing the website, sending an enquiry, discussing an opportunity or downloading a resource does not create an engagement, partnership, consortium, agency, employment, fiduciary, clinical or contractual relationship with GEMBA. Work begins only after the parties complete applicable due diligence, agree scope and responsibilities, obtain required approvals and enter into an appropriate written agreement.
Nothing on the website represents government endorsement, empanelment, procurement eligibility, pre-qualification, grant approval, funding commitment or an offer that can be accepted without formal process.
Using the website responsibly
You may access and use the website for lawful personal, educational or internal institutional reference. You may share a link to a public page and make limited quotations with clear attribution, subject to applicable law and any specific licence or notice accompanying the material.
- Do not copy, republish, sell, license, distribute or create a substantial derivative work from GEMBA content without written permission or another lawful basis.
- Do not use the GEMBA name, logo, tagline, brand assets or page design in a way that suggests endorsement, affiliation, partnership or authorship.
- Do not remove copyright, source, attribution, date, limitation or rights notices from downloaded or shared material.
- Nothing in these Terms restricts a use that applicable law expressly permits.
Content ownership and licences
Unless stated otherwise, GEMBA or its licensors own the website content, original text, visual identity, graphics and downloadable materials. Government data, research findings, photographs, third-party marks and cited publications remain subject to the rights, terms and attribution requirements of their respective owners.
A resource may carry a separate copyright, open licence, reuse note or attribution instruction. That specific notice takes precedence for the resource concerned.
For permission to reproduce GEMBA material beyond the use described here, contact info@gemba.org.in with the page or resource, proposed use, audience and format.
Do not misuse the website.
- Break or attempt to break any law, regulation, third-party right or security control.
- Probe, scan, attack, disrupt, overload, scrape at unreasonable scale, introduce malicious code or attempt unauthorised access.
- Misrepresent identity, authority, institutional affiliation or the purpose of an enquiry.
- Submit unlawful, threatening, discriminatory, defamatory, infringing, deceptive or harmful material.
- Submit patient, beneficiary, child, health-record, banking, identity-document, password, confidential bid or other sensitive information through a public form.
- Use website content or GEMBA branding to imply a relationship, endorsement, outcome or credential that does not exist.
GEMBA may restrict access, preserve relevant evidence or take other proportionate action where it reasonably believes the website is being misused, subject to applicable law.
Information you send to GEMBA
Use the public form only for a concise, non-confidential institutional or professional enquiry. GEMBA will handle personal data as described in the Privacy Policy, but submission of business information does not create a separate confidentiality agreement.
Do not send confidential proposals, unpublished bids, personal data about beneficiaries, research datasets, credentials or other restricted information unless GEMBA has agreed an appropriate follow-up route and any required confidentiality or data arrangement.
GEMBA may review, route, decline or request clarification of an enquiry. Receipt does not oblige GEMBA to respond within a fixed period, enter negotiations, reserve capacity or accept an assignment.
External websites
Links to external websites are provided for context or convenience. GEMBA does not control their content, availability, security, accessibility, terms or privacy practices. A link does not by itself indicate endorsement, partnership or responsibility. Use third-party resources under their own terms and exercise appropriate judgement.
Keeping information useful
GEMBA aims to present accurate and useful information, but website content may not always be complete, current or suitable for a particular decision. Laws, programmes, statistics, external pages and organisational information can change. Check primary sources and obtain appropriate advice before relying on material for a significant professional, clinical, financial, procurement or legal decision.
The website or a feature may be changed, suspended or unavailable for maintenance, security or other operational reasons. GEMBA does not guarantee uninterrupted, error-free or permanent access.
To report a material factual or accessibility issue, contact info@gemba.org.in and identify the relevant page.
Reasonable limits
To the extent permitted by applicable law, the website and its general information are provided on an 'as available' basis without a guarantee that every item will be complete, current, uninterrupted or suitable for every purpose. You remain responsible for how you use the information and for obtaining advice appropriate to your circumstances.
To the extent permitted by applicable law, GEMBA will not be responsible for indirect, incidental, special or consequential loss arising solely from use of, inability to use, or reliance on the website. Nothing in these Terms excludes or limits responsibility where exclusion or limitation is prohibited by law.
Applicable law
These Terms are governed by the laws of India. Subject to applicable law, any dispute will be addressed before a court or forum having competent jurisdiction in India.
Questions about these Terms may be sent to info@gemba.org.in.
GEMBA may update these Terms when the website, organisational practices or applicable requirements change. The revised version will show an updated date. Continued use after publication of revised Terms is subject to the version then displayed, to the extent permitted by applicable law.
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
